The Kharkiv Tractor Plant management is going to turn to the law-enforcement bodies asking them to check the information drawn from the public statements made by Vladislav Hubin, the ex-director general of the plant

The Kharkiv Tractor Plant management is going to turn to the law-enforcement bodies asking them to check the information drawn from the public statements made by Vladislav Hubin, the ex-director general of the plant.

The Kharkiv Tractor Plant management expresses their deep concern about public statements of the ex-director general of the Plant Vladislav V. Hubin that are related to the illegal change of management and the Plant’s form of ownership as well as about Mr Hubin’s alleged plans to return to the enterprise where nobody is looking forward to seeing him.

We would like to point out once again that Mr Hubin’s activities as the Plant’s CEO led to multi-million losses and his further sedition aimed at destabilizing the situation around the enterprise led to a more than four-month shutdown and withholding of payments to 2,500 employees.

The most disturbing fact is that Mr Hubin’s intentions voiced in his public statements absolutely match the general vector of the recent events at and around the Kharkiv Tractor Plant. In fact, the course of action which he has laid open to the public presupposes the change of the corporate control agent of the Kharkiv Tractor Plant JSC via the Plant’s bankruptcy proceedings as well as using the following instruments:

- using the administrative resource by the Security Service of Ukraine, the State Enforcement Service, the State Fiscal Service, the Commercial Court of the Kharkiv Region (as well as by appeal and review courts), and state courts;
- choosing and appointing a concerted arbitral manager;
- sanctioning and realizing the arbitral manager’s plan of action;
- “getting into” the Plant;
- appointing concerted assistants to the arbitral manager, including Mr Hubin, to actually run the Kharkiv Tractor Plant;
- taking preventive action like holding criminally accountable the people who hamper in the mentioned “Hubin plan”.

Taking into consideration the mentioned above facts and allowing for the clearly malicious and illegal character of the “Hubin plan”, the Kharkiv Tractor Plant JSC is planning to turn to the relevant law-enforcement bodies asking them to check the information mentioned in the statement of the Plant’s ex-director general and to provide its legal assessment. We consider the actions already taken by Mr Hubin personally or the actions taken with his assistance concerning the Kharkiv Tractor Plant to be explicitly hostile because these actions caused practically irreversible damage to the financial and productive capacities of the enterprise. At the moment, the management and the investor of the Kharkiv Tractor Plant are making every effort to fill the gap created by the damage and to breathe new life into the production, by, for example, attracting Western partners and investors. However, if the Plant is subjected to further attacks, it will hardly be possible to give life to the plans of saving the Plant – that will put paid to both launching production and reviving the enterprise. So the shareholders will have nothing else to do but to seek the damages from the guilty party.

Note. DCH Group became the investor in the Kharkiv Tractor Plant in late April, 2016. Since then they have succeeded in unfreezing the Plant and developing the plan of the Plant’s recovery; they have fully paid the salary arrears to the amount of more than 20 mln. UAH that were caused by the Plant’s stoppage; they have created a financial template of reviving the enterprise. Besides, DCH Group has established a credit line for the Kharkiv Tractor Plant to the amount of 400 mln. UAH through which the Plant’s activity will be financed.
