For the Third Time Already, DCH and Skyrizon Have Applied to the Antimonopoly Committee of Ukraine for Permission to Acquire

DCH Group and Chinese investors, represented in Ukraine by Skyrizon, applied to the Antimonopoly Committee of Ukraine for the third time to obtain permission for concentration by purchasing shares of PJSC Motor Sich.

Previously, the Antimonopoly Committee of Ukraine returned similar applications from DCH and Skyrizon without substantive consideration twice.

On 4 September 2020, the Chinese investors of PJSC Motor Sich submitted to the Ministry of Justice of Ukraine a pre-action document named the Notice of Investment Dispute about their intention to apply to international arbitration to recover losses from Ukraine of $3.5 billion. A representative of the Antimonopoly Committee of Ukraine will be a part of a working group on the pre-arbitration settlement.
