The state of Ukraine, represented by the government bodies, decided on restrictive measures, i.e. sanctions against Chinese investors of PJSC Motor Sich.
DCH Group had deeply studied the situation before taking part in the fate of PJSC Motor Sich. On our behalf, leading law firms conducted independent audits and provided their expert opinions. They came to a common conclusion – the Chinese investors are bona fide buyers and legal owners of the acquired shares in PJSC Motor Sich.
Therefore, the introduction of sanctions surprised us. We do not know the grounds for the decision as they are not specified in the text of the Decree of the President of Ukraine. It is only clear that the SSU is the initiator.
It is obvious that the state has the right to apply such measures in relation to certain legal entities and individual residents of other states without making the grounds public. However, one cannot but take into account that the sanctions were imposed directly on the eve of the extraordinary meeting of shareholders scheduled for 31 January 2021. And the purpose of the initiators could have been a ban on holding the meeting, which should have resulted in the restoration of Motor Sich's Chinese shareholders in their legal rights. Experts have yet to assess the legal and other consequences of Skyrizon's inclusion as the first Chinese company included in the sanctions list of Ukraine.
Chinese investors in PJSC Motor Sich are convinced that they are right and will continue to defend their legal rights and interests.
All further actions of DCH will be carried out considering our interest in the development of the Ukrainian aircraft industry and exclusively in the legal field.
